Terms of Service | Realhive

1. Introduction

Welcome to Realhive. Realhive is an online marketplace operated by RealWinners Technologies, operating under Kenyan law, trading under the business name Realhive, based in Nairobi, Kenya. By accessing or using the Realhive website, creating an account, listing a space, or making a booking, you agree to be fully bound by these Terms of Service. These Terms constitute a legally binding agreement between you and Realhive under the laws of the Republic of Kenya.

2. The Spacia Marketplace

Realhive is a marketplace platform only. Realhive does not own, operate, manage, or control any of the spaces listed on the Platform. Realhive is not a party to any agreement between a Host and a Guest. The contract for the use of a space is directly between the Host and the Guest.

3. User Accounts

You must be at least 18 years old to use this Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, truthful, and complete registration information.

4. Payments and Fees

All payments are processed in Kenyan Shillings (KES) via IntaSend, a CBK-licensed payment processor. Guests are charged the full booking amount plus a 10% Service Fee. Hosts receive 90% of the booking amount via M-Pesa B2C transfer, triggered automatically upon completion of the booking.

5. Cancellations and Refunds

Cancellations made more than 48 hours before the booking start time are eligible for a full refund minus the service fee. Cancellations within 48 hours of the booking start time are non-refundable. If a Host cancels a confirmed booking, the Guest receives a full refund including the Service Fee. Refunds are processed within 5-7 business days via M-Pesa.

6. Prohibited Conduct

You may not use the Platform for any unlawful purpose, provide false or misleading information, harass or discriminate against other users, attempt to conduct bookings outside of Spacia to avoid Service Fees, post false reviews, or impersonate any person or entity.

7. Limitation of Liability

Realhive is a marketplace platform and is not liable for personal injury or property damage at booked spaces, fraudulent listings created by Hosts, actions of any user, or losses arising from cancellations or disputes between users. Realhive's total aggregate liability shall not exceed the Service Fees paid in the three months preceding the claim.

8. Dispute Resolution

Disputes between users should first be attempted to be resolved directly. If unresolved, contact Realhive at info@joinrealhive.space. These Terms are governed by the laws of Kenya.
